The “dead-donor rule” states that, in any case of vital organ donation, the potential donor should be determined to be dead before transplantation occurs. In many countries around the world, neurological criteria can be used to legally determine death (also referred to as brain death). Nevertheless, there is considerable controversy in the bioethics literature over whether brain death is the equivalent of biological death. This international legal review demonstrates that there is considerable variability in how different jurisdictions have evolved to (...) justify the legal status of brain death and its relationship to the dead-donor rule.In this article, we chose to review approaches that are representative of many different jurisdictions—the United States takes an approach similar to that of many European countries; the United Kingdom’s approach is followed by Canada, India, and influences many other Commonwealth countries; Islamic jurisprudence is applicable to several different national laws; the Israeli approach is similar to many Western countries, but incorporates noteworthy modifications; and Japan’s relatively idiosyncratic approach has received some attention in the literature. Illuminating these different justifications may help develop respectful policies regarding organ donation within countries with diverse populations and allow for more informed debate about brain death and the deaddonor rule. We estimate that 208,000 deep brain stimulation (DBS) devices have been implanted to address neurological and neuropsychiatric disorders worldwide. DBS Think Tank presenters pooled data and determined that DBS expanded in its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. The DBS Think Tank was founded in 2012 providing a space where clinicians, engineers, researchers from industry and academia discuss current and emerging DBS technologies and logistical and ethical issues facing the field. (...) The emphasis is on cutting edge research and collaboration aimed to advance the DBS field. The Eighth Annual DBS Think Tank was held virtually on September 1 and 2, 2020 (Zoom Video Communications) due to restrictions related to the COVID-19 pandemic. The meeting focused on advances in: (1) optogenetics as a tool for comprehending neurobiology of diseases and on optogenetically-inspired DBS, (2) cutting edge of emerging DBS technologies, (3) ethical issues affecting DBS research and access to care, (4) neuromodulatory approaches for depression, (5) advancing novel hardware, software and imaging methodologies, (6) use of neurophysiological signals in adaptive neurostimulation, and (7) use of more advanced technologies to improve DBS clinical outcomes. There were 178 attendees who participated in a DBS Think Tank survey, which revealed the expansion of DBS into several indications such as obesity, post-traumatic stress disorder, addiction and Alzheimer’s disease. Comparative Political Theory and Cross-Cultural Philosophy explores new forms of philosophizing in the age of globalization by challenging the conventional border between the East and the West, as well as the traditional boundaries among different academic disciplines. This rich investigation demonstrates the importance of cross-cultural thinking in our reading of philosophical texts and explores how cross-cultural thinking transforms our understanding of the traditional philosophical paradigm.

In lieu of an abstract, here is a brief excerpt of the content:preface This special issue of Feminist Studies presents an eclectic view of women ’s friendships from across Western history and from several different cultures. Several of the articles question whether identity or sameness is a prerequisite for friendship and ask what friendships across difference look like, including charting the difficulties of making and sustaining such friendships. The articles in this issue contrast the variety and functions of women’s friendships (...) with the narcissistic masculinist ideals of classical Western thought about friendship in which friends serve as reflections of a person—typically a male and upper-class person. The authors in this issue present women’s friendships that are more pragmatic and more vulnerable and that contend more fully with difference. Some authors reflect on the high expectations placed on friendship within Second Wave feminism in the United States, noting how competition and feelings of betrayal can suffuse friendships; others trace more autonomous, productive, and forgiving contemporary visions of friendship. The issue opens with Susan Van Dyne’s archival study of student friendships in a pioneering US women’s college, revealing how love, flirtation, and desire between women was expressed in Smith College’s class of 1883. In another historical study, sociologist Harriet Bjerrum Nielsen contrasts the narratives of Norwegian girls and young women from the late nineteenth century with those of present-day women and girls, noting differences between rural and urban contexts. The vulnerability of women’s close relationships comes to the fore in Nancy K. Miller’s moving elegies for deceased feminist friends, while Judith Taylor explores the more open and autonomous friendships adumbrated in contemporary fictions by Zadie Smith and Jillian and Mariko Tamaki, themes also addressed in Judith Kegan Gardiner’s review essay of advice books on friendships between women and other studies of women’s friendships. This issue also presents internal negotiations of identity, identification, and body image in Stephanie Han’s short story and in the vivid and bold transgressions of Wangechi Mutu’s collages as described by Sarah Jane Cervenak. In “‘Abracadabra’: Intimate Inventions by Early College Women,” Susan Van Dyne takes us on a fascinating journey into the “the early formation of a homosocial student culture and the bonds between women” at Smith College in the late nineteenth century. Mining an archive of diaries, letters, photos, and other materials from a group of friends from the class of 1883, she focuses on two kinds of written evidence: one, the inchoate expressions of homoerotic desire in one student’s journal at a moment when “lesbian” did not yet exist as an identity, and the other, a love poem to two students, written as a parody by one of their women professors, but which reverberated beyond the college and ignited male opprobrium. In her discussions of these developments, rather than ascribing identity, Van Dyne navigates the “messiness” of the archive, keeping her eye trained on the “only partially intelligible strategies of self-representation that can’t be translated or reduced to the modern Preface 273 language of sexual self-recognition.” What is most surprising in her account is not that young women would feel desire for one another, nor that male peers or authorities might find this threatening, but that the fabric of the students’ homosocial community had such resilience, nurturing... Soren Kierkegaard, one of the most original thinkers of the nineteenth century, wrote widely on religious, psychological, and literary themes. This book shows how Kierkegaard developed his views in emphatic opposition to prevailing opinions. Since the development of assisted reproductive technologies, infertile individuals have crossed borders to obtain treatments unavailable or unaffordable in their own country. Recent media coverage has focused on the outsourcing of surrogacy to developing countries, where the cost for surrogacy is significantly less than the equivalent cost in a more developed country. This paper discusses the ethical arguments against international surrogacy. The major opposition viewpoints can be broadly divided into arguments about welfare, commodification and exploitation. It is argued that the (...) only valid objection to international surrogacy is that surrogate mothers may be exploited by being given too little compensation. However, the possibility of exploitation is a weak argument for prohibition, as employment alternatives for potential surrogate mothers may be more exploitative or more harmful than surrogacy. It is concluded that international surrogacy must be regulated, and the proposed regulatory mechanism is termed Fair Trade Surrogacy. The guidelines of Fair Trade Surrogacy focus on minimizing potential harms to all parties and ensuring fair compensation for surrogate mothers. (shrink)

Through extensive training, experts acquire specialized knowledge and abilities. In this paper, I argue that experts also acquire specialized visual experiences. Specifically, I articulate and defend the account that experts enjoy visual experiences that represent gestalt properties through perceptual learning. I survey an array of empirical studies on face perception and perceptual expertise that support this account. I also look at studies on perceptual adaptation that some might argue present a problem for my account. I show how the data are (...) subject to an interpretation that is friendly to it. Most moral dilemmas in medicine are analysed using the four principles with some consideration of consequentialism but these frameworks have limitations. It is not always clear how to judge which consequences are best. When principles conflict it is not always easy to decide which should dominate. They also do not take account of the importance of the emotional element of human experience. Virtue ethics is a framework that focuses on the character of the moral agent rather than the rightness of (...) an action. In considering the relationships, emotional sensitivities, and motivations that are unique to human society it provides a fuller ethical analysis and encourages more flexible and creative solutions than principlism or consequentialism alone. Two different moral dilemmas are analysed using virtue ethics in order to illustrate how it can enhance our approach to ethics in medicine. (shrink)

Marina Sbisà’s remarks on illocutionary pluralism suggest but do not constitute a full-blown theory. In this chapter I discuss two different attempts to build on those remarks. The first, illocutionary relativism, is my own attempt to develop the ideas presented in Sbisà’s remarks. The second, from Marcin Lewiński, differs in important ways. I then briefly compare these two varieties of illocutionary pluralism.

Barz (2018) contends that there is no specification of the phenomenon of first-person authority that avoids falsity or triviality. This paper offers one. When a subject self-ascribes a current conscious mental state in speech, there is a presumption that what she says is true. To defeat this presumption, one must be able to explain how she has been led astray.

Among philosophical analyses of Darwin’s Origin, a standard view says the theory presented there had no concrete observational consequences against which it might be checked. I challenge this idea with a new analysis of Darwin’s principal geographical distribution observations and how they connect to his common ancestry hypothesis.

This book uses the framework of care ethics to articulate a novel theory of our epistemic obligations to one another. It presents an original way to understand our epistemic vulnerabilities, our obligations in education, and our care-duties toward others with whom we stand in epistemically vulnerable relationships. As embodied and socially interdependent knowers, we have obligations to one another that are generated by our ability to care-that is to meet each other's epistemic vulnerabilities. The author begins the book by arguing (...) that the same motivations that moved social epistemologists away from individualistic epistemology should motivate a move to a care-based theory. The following chapters outline our epistemic care-duties to vulnerable agents, and offer criteria of epistemic goodness for communities of inquiry. Finally, the author discusses the tension between epistemic care and epistemic paternalism. Innovative research on decision making under ‘deep uncertainty’ is underway in applied fields such as engineering and operational research, largely outside the view of normative theorists grounded in decision theory. Applied methods and tools for decision support under deep uncertainty go beyond standard decision theory in the attention that they give to the structuring of decisions. Decision structuring is an important part of a broader philosophy of managing uncertainty in decision making, and normative decision theorists can both learn from, and (...) contribute to, the growing deep uncertainty decision support literature. Educators are increasingly concerned with the use of artificial intelligence (AI) in student writing. Much of the concern focuses on the issue of students using ChatGPT to complete their work. I introduce the CUPID model for instructors to use when thinking about how to pedagogically handle ChatGPT. The CUPID model lays out five general approaches: Catch, Utilize, Prevent, Ignore, and Disincentivize. I suggest that instructors should especially consider using certain assignments that fall under the approach “Disincentivize”. Philosophy instructors in particular (...) should assign more low-stakes writing, such as journals and reflection pieces. The adoption of low-stakes writing assignments aims to discourage students from relying on AI while promoting clarity of thought and deeper engagement with philosophical ideas. (shrink)

Kriegel has recently developed an adverbial account of intentionality, in part to solve the problem of how we can think of non-existents. The view has real virtues: it endorses a non-relational conception of intentionality and is ontologically conservative. Alas, the view ultimately cannot replace the act-object model of intentionality that it seeks to, because it depends on the act-object model for its intelligibility at key points. It thus fails as a revisionistic theory. I argue that the virtues of adverbialism can (...) be had from within the act-object framework, provided we understand intentional objects correctly. I use Crane as a guide here, and build on his work on intentional objects. In the end, we can provide a suitable solution to the problem of thinking of non-existents within the act-object framework without adopting implausible ontological or metaphysical views. Abstract: Does the evolving influence of humanity on the Earth’s environment call for new virtues? How might such virtues be seen as contributing to human flourishing? In this paper, I develop Aristotle’s discussion of magnificence and magnanimity to provide a framework within which to discuss such claims. I also defend the controversial view that even if genuinely new virtues may be involved, these may be virtues to which we should not aspire (now, or perhaps ever).

In the heart of southeast Texas, an industrial powerhouse often referred to as the 'Golden Triangle', the oil refineries and petrochemical plants stand as stalwart testaments to the region's economic evolution. Interestingly, before the discovery of oil at Spindletop, the lumber and cattle industries powered this region's economy. A profound shift occurred when the Lucas Gusher, a fountain of oil spurting thousands of feet into the air, struck the lands of Spindletop Hill on January 10, 1901. This remarkable discovery of (...) the Spindletop oilfield on a slat dome formation south of Beaumont, Texas, marked the birth of the modern petroleum industry and fundamentally transformed the region's geopolitical, economic, and cultural landscapes. People from all over the country relocated to Gladys City and Beaumont in search of work and new opportunities, creating a boomtown as the town's population swelled from 10,000 to 50,000. The newfound urbanization brought by the oil industry transformed the town and the surrounding areas, creating a ripple effect across the region that would be felt for generations to come. The surge in oil-driven economic activity transmuted the region into a vibrant nexus of commerce, with the oil industry emerging as a critical architect of growth and advancement. This newfound affluence incited by the petroleum sector ushered in an era of economic diversification, laying the groundwork for industrialization’s further evolution. The Spindletop Oil Fields not only underscored the United States’ ascent as the foremost petroleum-producing nation but also signaled the nation’s initiation into the Petroleum Age. It was Spindletop that solidified its position as America’s first significant oil field, becoming an enduring symbol of its industrial might. The Centers for Medicare & Medicaid Services has initiated bundled payments for hip and knee total joint replacement in an effort to decrease healthcare costs and increase quality of care. The ethical implications of this program have not been studied. This article considers the ethics of patient selection to improve outcomes; specifically, screening patients by body mass index to determine eligibility for total joint replacement. I argue that this type of screening is not ethically defensible, and that the bundled payment (...) program as structured is likely to lead to unfair restrictions on who receives total joint replacements. Linda Zagzebski makes a compelling and many-faceted case for the primacy of virtue in both epistemology and ethics, and for the thesis that "epistemic evaluation just is a form of moral evaluation". Along the way, she explores a variety of theoretical problems in both ethics and epistemology, advancing promising new analyses and solutions. For a work of contemporary epistemology, Virtues of the Mind is uncommonly readable, relevant, and historically informed—and Zagzebski manages all this without sacrificing depth or rigor. Pessimists about moral testimony hold that there is something suboptimal about forming moral beliefs by deferring to another. This paper motivates an analogous claim about self-knowledge of the reason-responsive attitudes. When it comes to your own mind, it seems important to know things “from the inside”, in the first-personal way, rather than putting your trust in another. After motivating Pessimism, the paper offers an explanation of its truth. First-person knowledge is distinctive because it involves knowing a state of mind and (...) finding it intelligible from one’s point of view.
